Volunteer Attorney Resolves SCRA Mortgage Interest Rate Problem for Soldier
An Army servicemember was struggling to keep up with his mortgage, as its high interest rate was materially affecting his ability to make the payments. The soldier requested that the mortgage company reduce the interest rate to 6 percent per the Servicemembers Civil Relief Act (SCRA). In violation of the SCRA, the mortgage company refused to reduce the interest rate. The soldier’s military legal assistance attorney referred this case to the ABA Military Pro Bono Project, which located a volunteer attorney who offered to help this soldier. The volunteer attorney successfully settled this case with the mortgage company. The mortgage company reduced the interest rate and provided the soldier with accrued damages from their violation of the SCRA interest rate.
